53-9-3. (Pre-1998 Probate Code) Issuance of letters of administration; force and effect


If, within the period of three months, evidence satisfactory to the judge of the probate court of the continuance in life of the decedent has not been produced, the judge of the probate court shall issue letters of administration or letters testamentary to the party entitled thereto were the supposed decedent known to be dead. The letters, until revoked, and the acts done in pursuance thereof and in reliance thereupon, including the sale of any real or personal property or any interest therein, shall be as valid as if the supposed decedent were dead.
