TITLE 53 - WILLS, TRUSTS, AND ADMINISTRATION OF ESTATES

CHAPTER 7 - ADMINISTRATION OF ESTATES GENERALLY
ARTICLE 2 - BONDS OF PERSONS CHARGED WITH ADMINISTRATION OF ESTATES AND ACTIONS THEREON
§ 53-7-32 - (Pre-1998 Probate Code) Requirement as to bond of executor generally; revocation of letters upon failure of executor to show cause; rules and regulations as to executors who give bond

O.C.G.A. 53-7-32 (2010)
53-7-32. (Pre-1998 Probate Code) Requirement as to bond of executor generally; revocation of letters upon failure of executor to show cause; rules and regulations as to executors who give bond

An executor shall not be required to give bond upon his qualification. However, the judge of the probate court, on his own motion or upon the representation of any person in interest that an executor is mismanaging the estate or is about to remove it from the state, may require an executor to show cause why he should not give bond and security for the faithful execution of his trust. On the failure of the executor to give bond when and as required, the judge may revoke his letters and appoint another representative for the estate. The executor who has given bond shall be liable to all the rules and regulations prescribed in reference to the bonds and sureties of administrators.
