53-7-123. (Pre-1998 Probate Code) Liability of sureties on first and second bonds; right of contribution


On removal of an administration as provided in this article, the sureties on the first bond are liable only for the conduct of the administrator or executor up to the time of removal; the sureties on the second bond are liable for all acts of the administrator or executor from the commencement of the administration. If the sureties on the second bond are made responsible for acts prior to the removal, they shall have a right of contribution against the sureties on the first bond.
