53-2-48. (Pre-1998 Probate Code) Nuncupative will -- Requirements generally


No nuncupative will shall be valid unless:

(1) The nuncupative will is proved by the oaths of at least two competent witnesses who were present at the making thereof;

(2) It is proved that the testator, at the time of pronouncing the same, told the persons present, or some of them, to bear witness that such was his will, or to that effect; and

(3) The nuncupative will was made in the time of the last sickness of the testator.
