53-2-104. (Pre-1998 Probate Code) Disposition of lapsed or void legacy or devise


(a) A lapsed or void legacy of personal property shall fall into the residuum and go to the residuary legatee.

(b) Ordinarily, real estate described in a lapsed or void devise shall descend to the heir; but under a devise necessarily contingent when the will was made, on failure of the contingency, the residuary legatee shall take.
