2013-03-05 8 0 ORDER by Judge Acosta - The court has reviewed the complaint and plaintiff's ex parte Motion 6 to Expedite or Accelerate Discovery. Plaintiff alleged claims of copyright infringement through the instrumentality of the Internet by one or more unknown defendants, through specific ISP addresses which plaintiff has identified. To serve the complaint and summons on these defendants, plaintiff must determine their identities. The ISPs through which these defendants have Internet access will be able to provide information identifying these defendants by name and address through the ISP address the particular ISP has assigned to each defendant. Until each defendant's identity is known to plaintiff, plaintiff cannot serve process on defendant and prosecute its case for copyright infringement. Accordingly, the court finds good cause exists for granting plaintiff's motion and, thus, plaintiff's motion 6 to expedite discovery is hereby GRANTED and the court orders that plaintiff may proceed with immediately beginning discovery before the conference required by Federal Rule of Civil Procedure 26(f)(1).
